1. Acceptance of Terms
By accessing or using JepCloud's platform, website, or any related services (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, you may not use the Service. These Terms apply to all users, including visitors, registered users, and customers.
2. Description of Service
JepCloud provides a DevOps-as-a-Service platform that automates cloud infrastructure provisioning, deployment pipelines, scaling, monitoring, and related services. The platform integrates with third-party cloud providers (AWS, GCP, Azure, DigitalOcean) and source control systems. JepCloud does not store or process your application data — all infrastructure runs within your own cloud account.
3. Account Registration
To access the Service, you must create an account. You agree to:
- Provide accurate, complete, and up-to-date registration information.
- Maintain the security of your credentials and notify us immediately of any unauthorized access.
- Be responsible for all activity occurring under your account.
- Not share your account credentials with third parties.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations.
- Infringe any intellectual property rights of third parties.
- Transmit malicious code, viruses, or any software intended to cause harm.
- Conduct unauthorized penetration testing, denial-of-service attacks, or security exploits against any system.
- Resell, sublicense, or otherwise make the Service available to third parties without our written consent.
- Attempt to gain unauthorized access to any part of the Service or its infrastructure.
5. Cloud Credentials and Data
JepCloud requires credentials to your cloud accounts (e.g., IAM roles, service account keys) solely to provision and manage infrastructure on your behalf. We operate on a least-privilege model, requesting only the permissions required to deliver the Service. Your application data remains entirely within your cloud account and is never accessed, stored, or processed by JepCloud.
6. Fees and Payment
Certain features of the Service require payment. By subscribing to a paid plan:
- You authorize us to charge your payment method on a recurring basis for the selected plan.
- Fees are non-refundable except as required by law or as expressly stated in our refund policy.
- We reserve the right to change pricing with 30 days' notice via email or the platform.
- You are responsible for applicable taxes in your jurisdiction.
7. Intellectual Property
The Service, including all software, designs, trademarks, and content, is the exclusive property of JepCloud and its licensors. Nothing in these Terms grants you any right to use JepCloud's name, trademarks, or proprietary content outside of the permitted use of the Service. You retain full ownership of your code, data, and any configurations you create.
8. Third-Party Services
The Service integrates with third-party platforms (cloud providers, source control, monitoring tools). Your use of those services is governed by their respective terms. JepCloud is not responsible for any acts or omissions of third-party providers, including service outages, pricing changes, or data loss on their platforms.
9. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JEPCLOUD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE THREE MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify, defend, and hold harmless JepCloud, its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, with reasonable notice where practicable. Upon termination, your right to use the Service ceases immediately. You may terminate your account at any time by contacting us. Provisions that by their nature should survive termination (including intellectual property, disclaimer, and limitation of liability clauses) will do so.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or a prominent notice on the platform at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
